Acceptance of these terms

These Terms of Service (the "Terms") are a legal agreement between you and Polu Systems ("Polu Systems," "we," "us," or "our"), the software division of Polu Hospitality Group, and govern your access to and use of polusystems.com and its content (the "Site"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

The Site and our products

The Site is an informational website that describes Polu Systems and its products. Access to and use of our software products and services, such as Resort Fare and Polu Suite Portal, is governed by separate written agreements between Polu Systems and each customer. Nothing on the Site is an offer, contract, or binding commitment to provide any product or service, and the descriptions on the Site are for general information only.

Permission to use the Site

We grant you a limited, non-exclusive, non-transferable, and revocable permission to access and view the Site for your own informational and non-commercial use, subject to these Terms. We may change, suspend, or discontinue any part of the Site at any time and without notice.

Intellectual property

The Site and its contents, including text, graphics, logos, images, page design, and the Polu Systems and Polu Hospitality Group names and marks, are owned by or licensed to Polu Systems and are protected by United States and other intellectual property laws. Except as expressly allowed by these Terms, you may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission. Product names and logos referenced on the Site are the property of their respective owners.

Acceptable use

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site. You agree not to:

• use the Site in violation of any applicable law or regulation;
• attempt to gain unauthorized access to the Site, its servers, or any connected systems or networks;
• interfere with or disrupt the operation, integrity, or security of the Site;
• use automated means to scrape, harvest, or collect content or data in a manner that burdens or harms the Site; or
• use the Site to transmit any malware or other harmful code.

The Site may contain links to third-party websites, including the website of Polu Hospitality Group. We provide these links for convenience only, and we do not control or endorse those sites. We are not responsible for the content, policies, or practices of any third-party website, and your use of them is at your own risk.

The information on the Site, including information about compliance, payments, and operations software, is provided for general informational purposes only and is not legal, financial, tax, or other professional advice. Disclaimer of warranties

The Site and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Limitation of liability

To the fullest extent permitted by law, Polu Systems, Polu Hospitality Group, and their officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to use, the Site. In no event will our total liability for all claims relating to the Site exceed one hundred United States dollars (US $100). Indemnification

You agree to indemnify and hold harmless Polu Systems, Polu Hospitality Group, and their officers, employees, and agents from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the Site or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Hawaiʻi and the United States, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Hawaiʻi, and you consent to the personal jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the effective date shown at the top of this page. Your continued use of the Site after changes take effect means you accept the updated Terms, so we encourage you to review this page periodically.

General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and Polu Systems regarding your use of the Site.
